These terms apply to your use of this website and to everything you buy from us. By placing an order you agree to them. Please read them alongside our Refund and Returns Policy, Delivery Policy, Subscription Cancellation Policy and Privacy Policy, which form part of these terms.

1. Who can buy

You must be at least 18 years old to place an order. Our programmes are designed for athletes aged 9 and over. Where the participant is under 18, a parent or legal guardian must make the purchase and is responsible for supervising participation.

2. Health, safety and assumption of risk

Please read this section carefully.

Speed and acceleration training places significant demands on the muscles, joints and cardiovascular system. Before beginning any TM Track Club programme, session or clinic, we strongly recommend you obtain clearance from a qualified medical professional, particularly if you have any pre-existing injury, underlying health condition, or concern about your readiness for high-intensity training.

We are coaches, not medical practitioners. Nothing we provide is medical advice, diagnosis or treatment. You are responsible for training within your capability, stopping if you experience pain, and seeking medical attention where needed. By participating you accept the inherent risks of athletic training, including the risk of injury.

3. No guarantee of results

Athletic outcomes depend on factors we do not control, including training consistency, sleep, nutrition, genetics, coaching history, injury and age. We describe our methods honestly and we do not promise any particular improvement in speed, times or performance.

4. Your licence to use our programmes

When you buy a digital programme, we grant you a personal, non-transferable, non-exclusive licence to use that material for your own training, or for the training of the athlete you purchased it for.

You may not copy, share, resell, publish, upload, distribute or make our programmes, videos or documents available to anyone else, and you may not use them to coach third parties commercially, without our written permission. All content on this site, including programmes, videos, images, text, and the TM Track Club name and logo, remains our intellectual property or that of our licensors.

We may suspend or terminate access, without refund, where material is shared or distributed in breach of this section.

5. Programme progression

Some programmes require completion of an earlier programme first. For example, Silver assumes you have completed Bronze. Please make sure you meet any stated prerequisite before purchasing.

6. Prices and payment

All prices are shown in New Zealand dollars (NZD). [GST STATEMENT TO BE CONFIRMED]

We accept the payment methods displayed at checkout. Payment is taken in full at the time of order unless the product is sold on a subscription. We may change prices at any time, but changes will not affect orders already placed.

We try to keep the site accurate, but if a product is listed at an obviously incorrect price we may cancel the order and refund you in full rather than supply at that price.

7. Bookings

Coaching sessions and clinic places are subject to availability and to confirmation by us. Purchase of a session or clinic place is not confirmation of a specific date or time until we confirm it with you.

8. Our liability

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where you are acquiring from us as a consumer.

Where you acquire from us for business purposes, the Consumer Guarantees Act does not apply, and to the extent permitted by law our liability is limited to the amount you paid for the relevant product.

To the extent the law allows, we are not liable for indirect or consequential loss, and we are not liable for injury or loss arising from you training contrary to medical advice or beyond your capability.

9. Site availability

We do our best to keep the site and your programme access available, but we do not guarantee uninterrupted access. We may change or withdraw products at any time.

10. Privacy

We handle personal information in accordance with the Privacy Act 2020 and our Privacy Policy.

11. Governing law

These terms are governed by New Zealand law, and the New Zealand courts and Disputes Tribunal have jurisdiction over any dispute.

12. Changes

We may update these terms. The version published on this site when you place your order is the version that applies to that order.
